Rental Term Rental Agreement Terms, Conditions & Policies:
A processed payment constitutes acceptance of these terms. Guests agree a signature may be requested but shall not be required as evidence of acceptance of these terms.
Property Type: Guest agrees that they are booking a property type based on size. While all efforts are made to accommodate specific property requests there are times when a reservation may be moved to a comparable property due to conditions beyond Management's control.
Check-In/Check-Out: The right to occupy the property begins at 4 pm on the “Check-In Date” and ends at 10 am on the “Check-Out Date” listed on Booking Confirmation (unless previously arranged) and will be strictly enforced in order to allow time for housekeeping to clean the property adequately between guests. Early check-in and late check-outs are subject to availability and cannot and will not be guaranteed.
Guest Restrictions & Maximum Occupancy: Registered Guest must be at least 21 years of age. Guests must be able to provide photo identification at any time before or during stay. Additional occupants above maximum occupancy is strictly prohibited. Each property may have an additional MAX of 2 daytime guests. Daytime guests are not permitted overnight.
Payment Policy & Schedule: To secure the booking, a payment of 25% of the grand total is due at time of booking if the arrival date is more than 30 days from time of booking. The remaining 75% is due 30 days prior to arrival date. A payment of 100% is due at time of booking for any reservation made inside 30 days of arrival. Rates are subject to change until reservation is confirmed. No dates will be held for reservation requests in which no deposit has been paid. Reservations are only confirmed upon receipt of deposit and receipt of Booking Confirmation. It is the responsibility of the guest to ensure accuracy of dates confirmed. After booking confirmed, rates or dates of reservation will not be adjusted for any newly published rates applicable to dates of existing reservations. When reservations are booked and paid directly through third-party website, any additional payments due will be requested and must be paid through the website used to book. Any payment schedules agreed upon at time of booking supersede payment schedule listed here. Service fees depend on website used to book reservation and are paid directly to website at time of booking and not paid to owner/manager. As a result, total amount due included in the Booking Confirmation does NOT include service fees nor can these be refunded or adjusted by the Manager. For any additional payments required, you will be emailed reminders from the site in which you booked which includes link to submit payment close to your due date. It is your responsibility to submit remaining balances due by the due date. Reservations in which balances are not timely paid are subject to cancellation without a refund.
Rental Rates, Departure Cleans, Amenity Fees & Taxes:
Cancellation Policy: All cancellation requests must be initiated in writing by the guest through website in which they booked. Cancellation requests received prior to 60 days from arrival date will receive a refund minus one night’s rent plus tax. Cancellation requests received inside 60 days from arrival date for cancelling the entire or portion of a reservation, refunds of deposits or full payments, no shows or early departures after check-in will result in a 100% loss of all funds remitted. We strongly encourage guests purchase travel insurance. There are many companies that provide this service. Guests covered under the travel insurance may be exempt from a loss if the reason for cancellation is covered under their policy. In the event of an Act of God such as adverse weather, tornadoes, fire, lightning strikes, etc., Beach Dreams, LLC and it's owners are not responsible for any refunds from monies which have been remitted. The Manager/Owner reserves the right to cancel any reservation for any reason subject to issuing a full refund without penalty or responsibility for providing lodging elsewhere.
Trip/Storm Insurance: We encourage all renters to purchase traveler insurance due to unforeseen eventualities including hurricane or tropical storms. Hurricane season is June 1st – November 30th. Weather or beach conditions cannot be guaranteed, and no refunds will be given from monies which have been paid or for providing lodging elsewhere unless the state or
local authorities order mandatory evacuations. For any day(s) that the authorities order a mandatory evacuation order for in a “Tropical Storm/Hurricane Warning,” area, we will refund: Any unused portion of rent from a guest currently staying; any unused portion of rent from a guest that is scheduled to arrive, and wants to shorten the stay, to come in after the “Warning” is lifted; and any advance rents collected for a reservation that is scheduled to arrive during the “Warning” period.
Hurricanes/Weather Events/Acts of God: In the event of an Act of God such as adverse weather, tornadoes, fire, lightning strikes, or otherwise, Beach Dreams, LLC, its affiliates and owners are not responsible for any refunds from monies which have been paid to Beach Dreams, LLC, or for providing lodging elsewhere. In the event of mandatory or voluntary evacuation, or a travel advisory, refunds are not issued. We strongly advise you to purchase the appropriate Travel/Trip Insurance to protect your investment and ensure suitable coverage from the insurance you purchase. Refunds will only be issued if the guest has purchased insurance coverage (which included the respective and required coverage for their specific claim). If a hurricane threatens the area, and a voluntary or mandatory evacuation is issued, our office will close, and all guests will be required to leave the island. Items left are not the responsibility of Beach Dreams, LLC or our owners.
Disputes: Guests understand that if there are ANY disputes or dissatisfaction regarding the vacation rental property paid herein, that said dispute should be taken up directly with Beach Dreams, LLC. I agree that I will not request a chargeback or credit to my credit card in connection with any charge made pursuant to this agreement. ANY credit card dispute that is received, the associated reservation(s) will be cancelled, and any funds will be retained by Beach Dreams, LLC. I hereby expressly waive my rights to request any chargeback against Beach Dreams, LLC now or in the future. All complaints must be reported during the customer’s stay and not after departing the property.
Refunds: Refunds issued by Beach Dreams, LLC will be submitted and/or processed no more than 30 days after departure date of original stay. Beach Dreams, LLC WILL NOT issue a refund to a guest unless the guest notifies Beach Dreams, LLC of the complaint immediately during their stay, while they are still on property; thus, providing Beach Dreams, LLC the opportunity to review and validate the issue or complaint with the guest present, and correct the issue(s) while the guest is still on property. Beach Closures, Public Road and/or Utility Closures and/or Work, Pool Closures, and Acts of God or Nature, are all outside of Beach Dreams, LLC control, and will not be refunded.
Pets: Pets are allowed under certain conditions and ALL animals, including service animals, must be disclosed, and approved prior to arrival. Fees are associated and charged due to the extended cleaning, deodorizing, and depreciation caused to the property. This fee is assessed for ALL animals, including emotional support animals. NO Animal is allowed in any of the Pool(s) or Spa(s), or on any of the Furniture, including beds. Upon departure, there will be an additional cleaning/damage fee if there is clear evidence that these rules were not followed. The pet fee is $50 per pet per night plus taxes. Dogs ONLY with 2 pet max. Weight limit of 50 lbs. max total for 1 or 2 pets. NO Dangerous Breeds, aggressive, or intimidating animals are allowed. Owner(s) of the animals is responsible for any damage, property damage, medical expenses, and/or excess cleaning that occurs due to the pet. We can require that any animal not in compliance with this be removed from the property without refund. In addition to this, any animal that urinates or defecates in the unit or pool area, is not well trained and is wild, and/or out of control, may also be required to leave the premises without refund.
“Dangerous dog” means: Any purebred or crossbred dog comprised of any of the following breeds: Pit Bull-type, Rottweiler, German Shepherd, Malamute, Doberman Pinscher, Chow Chow, any Wolf-dog hybrid, or any other dog that has been known to have bitten anyone where the injury required medical attention, or where any insured or any tenant, guest and/or visitor of the insured knew that a dog was potentially dangerous. Claiming a pet as a service animal, when it is not, is a criminal offense.
Payment Methods: The Guest should inform the Manager their mailing address and intended payment method. Credit card: Submit secured payment online by Credit/Debit Card/E-Check Cash: Cash payments will only be accepted in person for any reservation.
Check: We accept personal or certified checks from US bank accounts, or money order in EXACT AMOUNT DUE ONLY and must be postmarked within 24 hours of reservation request. Reservation requests where funds are not received by mail within 3 business days of request will be subject to cancellation. Pre-Arrival Details/Keys/Codes: Check-In information will be provided in an arrival Information email and or text number on file for the registered guest the day of check in.
Keys/Lock-Outs: Properties have either keyless entry or traditional keys. Codes will be digitally provided by check-in time for arrivals or guests will be informed regarding access to the unit and location of keys. Please take care of the keys provided to you as a lock-out fee of $50 applies for any after-hour lock out emergency calls. There will be a $25 fee if a key is not turned in upon check out or is lost.
Guest Restrictions: No daytime guests are allowed to stay overnight in the property if it exceeds the maximum overnight occupancy limit. Any person on property is the sole responsibility of Registered Guest.
Smoking: All our properties are a non-smoking. Smoking is not allowed inside or outside near any units. This includes cigars, e-cigarettes, etc. Violation of the no smoking policy in rooms will be subject to a $250 additional cleaning fee.
Noise: Guests should not create excessive noise at a level that disturbs neighbors; Code enforced neighborhood quiet hours are from 10:00p.m. – 7:00a.m. Police can issue tickets and fines and will notify us for violations in neighborhood areas. Any repeated reported violations of this can result in eviction.
Parking: Designated parking is limited to 1 vehicle. Please note, whenever possible we can make exceptions and provide additional parking if needed with some advance notice. Vehicles are to be parked in designated areas only parking on the road and in the right of ways is not permitted. Do not block entry of other parking areas or cars on property. Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner.
Property/Grounds: Keep the property and all furnishings in good order. Doors and windows should be closed and locked when property is not occupied. Do not remove any items, including bath towels and linens (excluding beach towels) or throw any items away without first notifying the manager. In the event of anything broken or damaged, please notify the manager immediately. Please be respectable of grounds, shared spaces, and other guests at all times.
Fire Safety: Only use appliances for their intended uses. Do not leave grills or ranges/ovens unattended. Fire extinguishers are located in the properties. Do not tamper with smoke detectors. Hearing-impaired smoke detectors are available upon request. Please notify owner/ manager if you require one during your stay. Familiarize yourself and guests with emergency exit maps.
Garbage: Please bag all garbage from the property in the cannisters provided. Do not leave bagged garbage outside at any time.
Pests: Florida has lots of bugs. Please be advised the building and grounds are routinely treated for pests. While every effort is made to use non-toxic treatments while rooms are vacant, pest control may be required to enter rooms in order to treat on schedule if needed. Follow recommendations regarding mosquito bite prevention. Please use caution with children who crawl on ground.
Grills: Grills are provided as a courtesy for use by all guests. Guests shall assume all the inherent risk associated with the use of the grills and shall supply their own fuel source. Please clean out the grill promptly following use and use caution when handling and disposing of hot coals or debris.
Pool Rules:
If you are in one of our properties with a shared pool, please observe the posted rules.
If you are in one of our properties with a private pool, please observe the following rules: No pets are allowed in the pool area. No outside alcohol is allowed inside pool fence. Please shower and remove all sand prior to entering pool. No glass or smoking is permitted in pool deck area. Children under 12 need adult supervision at all times. All non-toilet trained children must wear swim diapers at all times. No food, diving, or horseplay are allowed in pool. Please be advised that pool area is slippery when wet so we discourage running in pool area. Swim and walk in pool area at own risk.We closely monitor the pool. Please allow pool maintenance staff to perform duties during their visit. Generally speaking, our winter months are considered from November through April. During these months if you have purchased pool heat; we do our best to ensure that the pools are heated to a temperature of 82 degrees. However, please be aware that we do occasionally get cold spells that can send the temperatures down into the 30’s for a few nights in a row. This will cause the pool water temperature to draw down to in the 70’s and a pool pump will automatically shut down if the outside temperature gets too cold. The pump will then kick back on in the morning and begin re-heating of the pool back to 82, which may take several days depending on the severity of the cold spell. Ultimately, these situations are beyond our control. Weather/Storms: Hurricane season is June 1st – November 30th. Weather or beach conditions cannot be guaranteed, and refunds will only be given as outlined. Lightning is a real threat in Florida, take cover during storms. The pool area may be closed at any time at the discretion of manager without notice due to lightning or weather conditions.
City Ordinances: Guests are responsible for familiarizing themselves and abiding by rules and instructions set forth in the ordinances in the city in which they are renting or visiting.
Violations of Local Laws & Ordinances: Manager shall not be liable to guests or to any party for any type of issued violations, including but not limited to traffic tickets, noise complaints, turtle ordinance violations, etc. The sole responsibility lies with the registered guest. The City of Holmes Beach & Bradenton Beach Police, as well as the Manatee County Sheriff are authorized to ask anyone to leave the premises to at any time. Failure to do so may result in arrest in violation of trespassing.
The Most Up to Date Digital Property & Area Information: In your pre-arrival information and in the property, you will find link for a dedicated website for the property. This website provides all the necessary information that you may need during your stay with respect to the property. This includes WiFi information and passwords, rules, ordinances, local links, garbage days, specialized equipment instructions, emergency contacts, location of emergency exits and hurricane preparedness and contact information for the Property Manager. Please familiarize yourself with this website when you receive your pre-arrival instructions.
Indemnity & Waiver of Liability: The Guest agrees to indemnify and hold owner/manager not responsible for any accidents, injuries, illness, or loss of personal belongings that occurs to any guests or visitors of guest while on the premises or its' facilities. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to the premise. Guest agrees not to give code or key to unregistered guests or visitors.
Use of Property: Property is intended solely for the rental period and guest’s personal use. No use for business, trade, publicity, gatherings/meetings without explicit approval of Manager/owner. No illegal activities. Guest shall not assign his or her rights under this agreement, or sublet the property, in whole or part, to another party. This guarantees cancellation of reservation and/or immediate eviction from property. Owner retains the right to assign his or her rights under this agreement to a third party without notice.
Construction/Home for Sale: In the event of neighboring construction or sale of home, Manager shall not be held responsible to provide any type of advance notification to incoming guests. Property views are subject to change due to construction that may occur. In the event the building is for sale, while all efforts are made to honor existing reservations Manager/Owner shall not be held responsible if Buyer does not honor existing reservations and are subject to refund per Cancellation Policy.
Privacy Policy: We are the sole owners of the information collected on this site. We only have access to/collect information that you voluntarily give us via email or other direct contact from you. We will not sell or rent this information to anyone. We will use your information to respond to you, regarding the reason you contacted us. We will not share your information with any third party outside of our organization, other than as necessary to fulfill your request. Unless you ask us not to, we may contact you via email in the future to tell you about specials, new products or services, or changes to this privacy policy. You may opt out of any future contacts from us at any time. You can do the following at any time by contacting us via the email address or phone number given on our website:
Social Media & Internet Marketing: We do participate in the use of conversion tracking concerning our social media audiences. We adhere to their legal and moral guidelines, policies, and procedures to ensure privacy to our users and ownership of their information. All conversion tracking is anonymous and better aids our company to provide the best user experiences for our guests. During occupancy of this rental property AND thereafter, Guest agrees to take no action which may harm Management’s reputation, or which would reasonably be expected to lead to unfavorable publicity. This includes, but is not limited to, online comments and/or public remarks which may result in restriction of trade or negative business.
Security: We take precautions to protect your information. When you submit sensitive information via the website, your information is protected both online and offline. Wherever we collect sensitive information (such as credit card data), that information is encrypted and transmitted to us in a secure way. You can verify this by looking for a closed lock icon at the bottom of your web browser or looking for “https” at the beginning of the address of the web page. While we use encryption to protect sensitive information transmitted online, we also protect your information offline. Only employees who need the information to perform a specific job (for example, billing or customer service) are granted access to personally identifiable information. The computers/servers in which we store personally identifiable information are kept in a secure environment.
Failure of Equipment/Poor Condition: In the event of failure of equipment to work, please notify us first so repairs can be made. Renter expressly waives and relinquishes any rights or claims against Owner or Manager for any damage that may result to renter from lack of maintenance, cleanliness, repair, defect including owners or managers for ordinary negligence. There will be no refund of all or part of the rental amount for any failure of any of the equipment to work. Maintenance and inspection of the unit may occur during your stay. In this case our service providers might require access to the unit, with or without formal notice.
Lost & Found: Manager is not liable for any items left behind. If you leave something behind and would like it shipped to you, you will be responsible for any mailing/shipping charges.
